LIABILITY WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND INDEMNIFICATION AGREEMENT

Operator Syndicate Series, a production of Global Independent, LLC

In consideration of being permitted to participate in the Operator Syndicate Series live fire tactical fitness challenge and all related activities, training, competitions, and events (collectively, the “Event”), produced by Global Independent, LLC (the “Company”), I (the “Participant,” or if a minor, my parent or legal guardian signing on my behalf) agree to the following terms. This Agreement is entered into voluntarily and is intended to be as broad and inclusive as permitted by law.

1. Description of the Activity and Voluntary Participation

The Event consists of high-intensity live-fire tactical fitness challenges involving strenuous physical exercises, tactical movements, obstacle navigation, dynamic shooting scenarios, and the use/discharge of firearms with live ammunition. Participation is purely voluntary. I elect to participate despite the risks.

2. Assumption of Risk

I understand and acknowledge that the Event involves inherent and extreme risks of serious personal injury, property damage, or death. These risks cannot be eliminated and include, but are not limited to:

Fitness activity risks: Muscle strains, sprains, fractures, joint dislocations, back or neck injuries, cardiovascular events (e.g., heart attack, stroke), heat exhaustion, dehydration, exhaustion, or other harms from strenuous physical exertion, running, lifting, climbing, or tactical movements.

Firearms-related risks: Accidental discharge or misuse of firearms by myself or other competitors/participants, ricochets, misfires, backspatter, flying debris/projectiles, lead exposure, hearing loss, eye injury, burns, or being struck by bullets or fragments.

Exercise equipment and apparatus failures: Malfunction, breakage, or failure of firearms, ammunition, targets, safety gear, fitness equipment, obstacles, barriers, platforms, or any other apparatus or facilities.

Risks arising from the negligence, actions, or omissions of the Company, its staff, volunteers, contractors, other competitors/participants, or third parties.

Environmental hazards, venue conditions, weather, slips/falls, collisions, or other unforeseen events.

I am in good physical and mental health, have no medical conditions that prevent safe participation, am legally eligible to possess and use firearms under all applicable laws, and have received (or will receive) appropriate safety training. I agree to follow all rules, safety briefings, instructions, and directions from Event staff at all times. I voluntarily assume all risks, known and unknown, and agree that my participation is entirely at my own risk.

3. Release of Liability

I, for myself, my heirs, executors, administrators, assigns, and next of kin, hereby release, waive, discharge, and covenant not to sue the Company (Global Independent, LLC), its officers, directors, members, managers, employees, agents, contractors, volunteers, sponsors, affiliates, successors, assigns, and any venues, facilities, or partners used for the Event (collectively, the “Releasees”) from any and all liability, claims, demands, actions, or causes of action whatsoever (whether in law or equity, known or unknown, including but not limited to claims based on negligence, gross negligence, recklessness, or intentional acts) for any loss, damage, injury (including death), or expense arising out of or in any way connected with my participation in the Event, including risks from fitness activities, firearms accidents (self or others), or equipment failures.

4. Indemnification and Hold Harmless

I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, suits, actions, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from my participation in the Event, my use of any equipment or facilities, or any act or omission by me (or any minor under my supervision).

5. Medical Treatment Authorization

In the event of injury or illness, I authorize the Releasees or their designees to provide or arrange emergency medical care (including first aid, CPR, AED use, or transport). I agree to pay all associated costs and understand that the Company provides no medical, health, or accident insurance for participants. I am responsible for obtaining my own coverage.

6. Additional Acknowledgments

I am not under the influence of alcohol, illegal drugs, or any impairing substances.

I will wear appropriate safety gear (eye/ear protection, etc.) as required.

The Company is not responsible for loss, theft, or damage to my personal property, including firearms or equipment.

This Agreement remains in effect for the duration of my participation in the Event (including all sessions, competitions, or related activities).

7. Governing Law and Severability

This Agreement shall be governed by the laws of the State of Ohio (or the state where the specific Event occurs), without regard to conflict of laws principles. If any provision is held invalid or unenforceable, the remainder shall continue in full force and effect.

8. Acknowledgment and Signature

I have carefully read this entire Agreement, fully understand its terms and legal effect (including the waiver of substantial legal rights), and sign it freely and voluntarily without duress. I acknowledge that this document affects my legal rights and binds my heirs and assigns.
